Evergrow ('we', 'our', 'us') is committed to protecting the privacy of our users ('you', 'your'). This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use the Evergrow mobile application ('App') and associated services.

We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained in that Act. This Privacy Policy also addresses our obligations under the General Data Protection Regulation (GDPR) for users in the European Union.

By downloading, installing, or using the Evergrow App, you acknowledge that you have read, understood, and agree to the terms of this Privacy Policy. If you do not agree with these terms, please do not use the App.

2. Who We Are

Evergrow is developed and operated by Alaskah Hindry, a registered Paediatric Occupational Therapist based in New South Wales, Australia. The App is designed to provide evidence-based play, developmental, and wellbeing support to parents and caregivers of children aged 0 to 24 months.

3. Information We Collect

We collect the following categories of personal and non-personal information:

3.1 Information You Provide Directly

•       Parent or caregiver first name

•       Baby's first name

•       Baby's date of birth

•       Baby's gestational age or premature birth status

•       Email address (if you create an account)

•       Onboarding preferences and interests

•       Gratitude journal entries

•       Weekly reflection entries

•       Product review requests submitted via the Worth It feature

•       Feedback submitted through the app

3.2 Information Collected Automatically

•       Anonymous device identifier (randomly generated UUID, not linked to your identity)

•       App usage data and interaction patterns

•       Crash reports and error logs

•       Device type and operating system version

•       Notification preferences

3.3 Information We Do Not Collect

We do not collect:

•       Financial or payment information (all payments are processed by Apple via the App Store)

•       Government-issued identification numbers

•       Health records or clinical diagnoses

•       Location data

•       Contacts, photos, or camera access (unless you explicitly grant permission for a specific feature)

•       Political, religious or philosophical opinions, beliefs or affiliations

•       Racial or ethnic origin

•       Criminal records

4. How We Use Your Information

We use the information we collect to:

•       Personalise the App experience with your baby's name, age, and developmental stage

•       Provide age-appropriate activity recommendations, developmental milestone guidance, and wellbeing content

•       Save your progress, preferences, gratitude entries, and reflections

•       Send push notifications about activities, developmental milestones, and wellbeing check-ins (only with your permission)

•       Improve the App's content, features, and user experience

•       Respond to your feedback and support requests

•       Ensure the security and integrity of the App

•       Comply with our legal obligations under Australian law

•       Analyse aggregated, anonymised usage data to understand how the App is being used

5. Legal Basis for Processing (GDPR)

For users in the European Union, we process your personal data on the following legal bases:

•       Contractual necessity: to provide the App services you have requested

•       Legitimate interests: to improve our App and ensure its security

•       Consent: for optional features such as push notifications and gratitude journalling

•       Legal obligation: to comply with applicable laws and regulations

6. Data Storage and Security

Your data is stored using the following technologies and practices:

•       Sensitive personal information (baby name, date of birth, parent name, premature birth status) is stored in the iOS Keychain on your device — a secure, encrypted storage system provided by Apple

•       App content data is stored on Supabase, a PostgreSQL-based cloud database hosted on AWS infrastructure

•       All data transmission between the App and our servers is encrypted using HTTPS/TLS

•       Row Level Security (RLS) policies are enforced on all database tables

•       We do not store payment information — all transactions are handled by Apple

We implement industry-standard security measures to protect your personal information. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

7. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with the App's services. Specifically:

•       Account data: retained until you delete your account

•       Journal entries and reflections: stored locally on your device and retained until you delete them or uninstall the App

•       Crash reports and usage data: retained for up to 12 months

•       Anonymised aggregated data: may be retained indefinitely for research and improvement purposes

8. Disposal of Personal Information

If we hold personal information about you and we no longer need that information for any purpose for which it may be used or disclosed, we will take reasonable steps to destroy or de-identify that information, unless we are prevented from doing so by law or a court or tribunal order.

Where personal information is stored on your device (such as in the iOS Keychain), you may delete this information at any time by using the 'Delete my data' function within the App, or by uninstalling the App from your device.

9. Sharing of Your Information

We do not sell, distribute, rent, licence, disclose, share or pass your personal information onto any third parties, other than those who are contracted to us and are bound to keep the information confidential. We may share your information in the following limited circumstances:

•       Service providers: We use Supabase as our database provider under strict data processing agreements

•       Analytics and crash reporting: Third-party tools such as Sentry receive anonymised technical data only

•       Apple: App Store transactions and Sign in with Apple authentication are processed by Apple under their own privacy policy

•       Legal requirements: We may disclose your information if required by law, court order, or governmental authority. Where it is lawful and reasonable to do so, we will take reasonable steps to notify you in advance of any such disclosure

•       Business transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred to the acquiring entity subject to the same privacy protections

Should a third party approach us with a demand to access your personal information, we will take reasonable steps to redirect the third party to request the information directly from you, wherever it is lawful and reasonable to do so.

10. Overseas Transfer of Personal Information

We may transfer your personal information to overseas recipients, including Supabase (hosted on AWS infrastructure). We will take reasonable steps to ensure that any overseas recipient handles your personal information in a way that is consistent with the Australian Privacy Principles under the Privacy Act 1988 (Cth). Where required, we will seek your consent prior to disclosing your information to an overseas recipient that is not regulated in a way that equally reflects the Australian Privacy Principles.

11. Cookies and Tracking

The Evergrow iOS App does not use cookies. We do not use cross-site tracking technologies. Any analytics data collected is anonymised and aggregated. If future versions of the App include a web-based component that uses cookies, we will update this policy accordingly and provide you with the option to disable cookies through your browser or device settings.

12. Children's Privacy

The Evergrow App is designed for use by parents, caregivers, and health professionals — it is not directed at children. We collect information about babies and toddlers (such as name and date of birth) solely for the purpose of personalising the parent's experience within the App.

We do not knowingly collect personal information directly from children under the age of 13. If you are a parent or guardian and believe your child has provided us with personal information without your consent, please contact us at hello@evergrowapp.com.au and we will take steps to remove that information.

13. Your Rights and Choices

You have the following rights regarding your personal information:

•       Access: You can request a copy of the personal information we hold about you. We will respond as quickly as possible. Requests for large amounts of information may require additional time. We may charge a reasonable fee for access if a cost is incurred, but will notify you of any fee before proceeding

•       Correction: You can update or correct your personal information through the App's profile settings or by contacting us

•       Deletion: You can request the deletion of your personal information by contacting us or using the 'Delete my data' function within the App

•       Portability: You can request a copy of your data in a portable format

•       Opt-out of notifications: You can disable push notifications at any time through your device settings

•       Withdraw consent: Where processing is based on consent, you may withdraw consent at any time

To exercise any of these rights, please contact us at hello@evergrowapp.com.au. We will respond to your request within 30 days.

In some circumstances we may refuse access or correction requests. If we refuse, we will provide reasons for our decision (unless unreasonable to do so) and details of how you may make a complaint about our decision.

14. Unsubscribing from Communications

If you have opted in to receive email communications from Evergrow, you may unsubscribe at any time by clicking the unsubscribe link in any email we send, or by emailing hello@evergrowapp.com.au with 'UNSUBSCRIBE' in the subject line. Push notification preferences can be managed through your device settings at any time.

15. Third-Party Links

The App may contain links to third-party websites or resources. We are not responsible for the privacy practices or content of those third parties. We encourage you to review the privacy policies of any third-party sites you visit.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Where significant amendments occur, we will provide notification via the App at least 14 days prior to the changes being implemented, unless the circumstances of the amendments make it unreasonable to provide such a notice period. Your continued use of the App after the notice period has lapsed indicates your consent to be bound by the amended Privacy Policy.

We will also update the effective date at the top of this policy when changes are made.

17. Concerns and Complaints

If you have concerns about how we handle your personal information, please notify us as soon as possible by contacting our Privacy Officer at hello@evergrowapp.com.au. Please make your concern or complaint in writing. We will respond as soon as reasonably possible.

If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

TERMS OF USE

1. Acceptance of Terms

By downloading, installing, or using the Evergrow mobile application ('App'), you agree to be bound by these Terms of Use ('Terms'). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Evergrow (operated by Alaskah Hindry, NSW, Australia). We reserve the right to modify these Terms at any time. Where significant changes are made, we will provide at least 14 days notice via the App before changes take effect. Continued use of the App after that notice period constitutes acceptance of the revised Terms.

2. Description of Service

Evergrow is a mobile application designed to provide parents and caregivers of children aged 0 to 24 months with:

•       Evidence-based play and developmental activity ideas

•       Developmental milestone information and guidance

•       Parent wellbeing support tools including journalling and self-care resources

•       Educational editorial content about child development and parenting

•       Occupational therapist-informed product reviews (Worth It feature)

3. Eligibility

You must be at least 18 years of age to use the Evergrow App. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Account Registration

To access certain features of the App, you may be required to create an account. You agree to:

•       Provide accurate, current, and complete information during registration

•       Maintain the security of your account credentials

•       Notify us immediately of any unauthorised access to your account

•       Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

5. Subscriptions and Payments

Evergrow offers both free and premium subscription tiers. Premium features are available through an auto-renewing subscription:

•       Monthly subscription: AUD $7.99 per month

•       Annual subscription: AUD $59.99 per year

•       A 7-day free trial is available for new subscribers

Subscriptions are processed through the Apple App Store. By subscribing, you agree to Apple's payment terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period. You can manage and cancel subscriptions through your Apple ID account settings.

We do not offer refunds for partial subscription periods, except as required by Australian Consumer Law.

6. Intellectual Property

All content within the Evergrow App, including but not limited to text, graphics, logos, images, activity descriptions, milestone information, and the app design, is the intellectual property of Evergrow and is protected by Australian and international copyright laws.

You may not:

•       Copy, reproduce, distribute, or create derivative works from App content without our express written permission

•       Use our content for commercial purposes without authorisation

•       Remove any copyright or proprietary notices from our content

The Evergrow name, logo, and taglines are trademarks of Evergrow. Unauthorised use is prohibited.

7. User Conduct

You agree not to use the App to:

•       Violate any applicable laws or regulations

•       Transmit any harmful, offensive, or inappropriate content

•       Attempt to gain unauthorised access to our systems or other users' accounts

•       Interfere with the App's functionality or security

•       Scrape, copy, or harvest data from the App without our permission

•       Impersonate any person or entity

8. Disclaimer of Warranties

The Evergrow App is provided 'as is' and 'as available' without warranties of any kind, either express or implied. To the fullest extent permitted by Australian law, we disclaim all warranties including but not limited to implied warranties of merchantability and fitness for a particular purpose.

9. Limitation of Liability

To the fullest extent permitted by law, Evergrow and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability to you for any claims shall not exceed the amount you paid in the 12 months preceding the claim.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or other right you may have under the Australian Consumer Law that cannot be excluded.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

11. Termination

We reserve the right to terminate or suspend your access to the App at any time for conduct that violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease.

1. Important Notice — Please Read Carefully

This Health and Medical Disclaimer applies to all content, activities, milestone information, product reviews, and wellbeing tools provided through the Evergrow mobile application ('App'). By using the App, you acknowledge and agree to the terms of this Disclaimer.

THE EVERGROW APP DOES NOT PROVIDE MEDICAL, THERAPEUTIC, CLINICAL, OR PROFESSIONAL HEALTH ADVICE. THE CONTENT IS FOR GENERAL EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY.

2. Nature of the Content

Evergrow is developed by Alaskah Hindry, a registered Paediatric Occupational Therapist in Australia. The content within the App reflects general educational information based on evidence-based practice in paediatric occupational therapy, child development research, and allied health literature.

The App is NOT:

•       A substitute for professional medical, therapeutic, or clinical assessment

•       A substitute for advice from your child's GP, paediatrician, occupational therapist, speech pathologist, physiotherapist, or other registered health professional

•       A diagnostic tool for developmental delays, disabilities, or health conditions

•       A treatment program or therapeutic intervention

•       A replacement for the Maternal and Child Health (MCH) service or similar government-funded child health services

3. Developmental Milestones

The developmental milestone information provided in the App is based on general population norms sourced from peer-reviewed research, the Centers for Disease Control and Prevention (CDC), and recognised Australian and international paediatric guidelines.

Developmental milestones represent a range of typical development — they are NOT diagnostic criteria. Every child develops at their own pace. The presence or absence of a milestone within the timeframe indicated does not necessarily indicate a developmental delay or disorder.

If you have any concerns about your child's development, please consult a qualified health professional such as a Paediatric Occupational Therapist, Speech Pathologist, Physiotherapist, Paediatrician, or your GP.

4. Activity Recommendations

All activity ideas and play suggestions provided in the App are general educational recommendations intended to support typical child development. They are not therapeutic exercises or clinical interventions.

You are solely responsible for:

•       Assessing whether any activity is appropriate for your individual child

•       Supervising your child at all times during any suggested activity

•       Modifying activities to suit your child's individual abilities, temperament, and safety needs

•       Discontinuing any activity that causes distress, discomfort, or safety concerns

If your child has a diagnosed medical condition, developmental delay, disability, or has been born prematurely, please consult your treating health professional before commencing any activity suggested in the App.

5. Parent Wellbeing Content

The wellbeing tools and content provided in the App, including self-care suggestions, gratitude journalling, and reflective exercises, are intended as general wellbeing support tools only. They are NOT a substitute for mental health treatment, psychological therapy, counselling, or psychiatric care.

If you are experiencing significant emotional distress, postnatal depression, anxiety, or other mental health concerns, please seek support from a qualified mental health professional. In Australia, the following services are available:

Product reviews and assessments in the Worth It section represent the personal professional opinion of Alaskah Hindry as a registered Paediatric Occupational Therapist. These reviews:

•       Are not independent clinical trials or peer-reviewed research

•       Reflect one professional's opinion and may not align with all health professionals

•       Do not constitute an endorsement or guarantee of any product's safety or suitability for your individual child

•       Should not replace your own assessment of a product's suitability

Always assess the safety and age-appropriateness of any product for your individual child. Follow the manufacturer's instructions and age recommendations at all times. Supervise your child when using any toy or product.

7. Premature Birth and Special Needs

The App provides adjusted age functionality for babies born prematurely. However, premature babies and children with special needs may have complex developmental profiles that require individualised assessment and support from a multi-disciplinary health team. Please use the App's content as a general supplement only, not as a primary source of developmental guidance, and work closely with your treating health professionals.

8. No Professional Relationship

Your use of the Evergrow App does not create a professional relationship (including a therapeutic, clinical, or doctor-patient relationship) between you and Alaskah Hindry or Evergrow. The information provided is not personalised to your individual child's medical history, developmental profile, or clinical needs.

9. Seek Professional Advice

Always seek the advice of a qualified health professional with any questions you may have regarding your child's health, development, or wellbeing. Never disregard professional medical advice or delay seeking it because of something you have read or seen in the Evergrow App.

If you believe your child may be experiencing a medical emergency, call 000 (Australia) immediately.

10. Accuracy of Information

We make every effort to ensure the information in the App is accurate, evidence-based, and up to date. However, child development research is an evolving field. We cannot guarantee that all information is complete, current, or applicable to every child. We accept no responsibility for any errors or omissions, or for any outcomes resulting from reliance on the App's information.

11. TGA Compliance

The Evergrow App is a general wellness application and is not intended to be a medical device as defined under the Therapeutic Goods Act 1989 (Cth). The App does not diagnose, treat, cure, or prevent any disease or health condition.

12. Updates to This Disclaimer

We reserve the right to update this Disclaimer at any time. Where significant changes are made, we will provide at least 14 days notice via the App before changes take effect. Continued use after the notice period constitutes acceptance of the updated Disclaimer.
